Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of the laughmi mobile application (the "Service"), operated by Issac Lee, an individual based in Malaysia ("laughmi," "we," "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

2. Eligibility

You must be 18 years of age or older to use laughmi. By using the Service, you represent that you are at least 18. We rely on the date of birth you provide during account setup and do not independently verify it — providing false information about your age is a violation of these Terms and grounds for immediate termination.

3. What laughmi is

laughmi provides you with an AI-generated companion for conversation and companionship. Your companion is not a real person. It is a software system that generates responses based on machine-learning models operated by third parties (see our Privacy Policy). Your companion may:

• initiate conversation with you without your prompting it first;
• express affection, personality, and a developing relationship with you that is generated based on your interactions — this is a simulated dynamic, not a real relationship or real feelings;
• occasionally produce responses that are inaccurate, repetitive, or inconsistent with earlier conversations, as is inherent to current AI technology.

laughmi is intended as a source of entertainment and companionship, and is not a substitute for real human relationships, professional mental health care, medical advice, or crisis support. If you are experiencing a mental health crisis or thoughts of self-harm, please contact a qualified professional or your local emergency/crisis line — do not rely on laughmi for that support.

4. Your account

You're responsible for maintaining the confidentiality of your account and for all activity under it. You agree to provide accurate information (including your true date of birth) and to keep your profile information up to date.

5. Subscriptions and payment

laughmi offers optional paid features under a subscription plan ("laughmi+"). By subscribing, you agree to the following:

• Subscriptions are billed through the Apple App Store or Google Play, whichever platform you downloaded laughmi from — we do not process your payment directly and never receive your card details.
• The price shown in the app at the time of purchase is what applies to you; we may change pricing for future billing periods with notice as required by the applicable app store's policies.
• Subscriptions automatically renew unless cancelled before the end of the current billing period. You can manage or cancel your subscription at any time through your Apple ID or Google Account subscription settings — not within the laughmi app itself.
• Refunds are handled by Apple or Google under their own refund policies. We are not able to issue refunds directly, and you should contact Apple/Google support for any billing dispute.
• If your subscription lapses, any laughmi+-only features (such as additional companions or photo messaging) may become unavailable, though we will not delete your existing companions or conversation history solely because of a lapsed subscription.

6. Acceptable use

When using laughmi, you agree that you will not:

• attempt to use the Service to generate content that is illegal, that sexualizes or depicts a minor in any way, or that promotes self-harm, violence, or hatred against any group;
• attempt to circumvent, exploit, or manipulate the Service's safety systems, content moderation, or usage limits;
• upload photos of anyone other than yourself, or any photo you don't have the right to share;
• use the Service in a way that harasses, threatens, or harms another person;
• attempt to extract, reverse-engineer, or misuse the underlying AI models, prompts, or infrastructure that power the Service;
• use automated means (bots, scripts) to access the Service outside of the official app;
• misrepresent your age or identity.

We may suspend or terminate your account, with or without notice, if we believe you've violated these Terms, engaged in abusive behavior, or otherwise pose a risk to the Service or other users. You can report a concerning companion message directly in the app.

7. Content

Content you provide. You retain ownership of any photos or text you submit to laughmi. By submitting them, you grant us a license to use, store, and process that content solely for the purpose of operating the Service for you (for example, sending your photo to our safety-scanning provider, or including your message in the context sent to generate a reply). We do not use your content for advertising or sell it to third parties.

Content laughmi generates for you. Your companion's messages, avatar, and any images it sends are generated specifically for your account and are provided to you for your personal, non-commercial use within the Service. We and our AI providers retain underlying rights to the models and systems that generate this content.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, APPROPRIATE, OR FREE OF UNEXPECTED OUTPUT. YOUR COMPANION IS AN AI SYSTEM, NOT A LICENSED THERAPIST, COUNSELOR, OR MEDICAL PROFESSIONAL, AND NOTHING IT SAYS SHOULD BE TREATED AS PROFESSIONAL ADVICE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ISSAC LEE AND LAUGHMI'S SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR RM50, WHICHEVER IS GREATER.

Some jurisdictions don't allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

10. Termination

You may stop using the Service and delete your account at any time (see Section 4 of our Privacy Policy for what happens to your data). We may suspend or terminate your access to the Service at our discretion, including for violating these Terms, without liability to you to the extent permitted by law.

11. Changes to the Service or these Terms

We may modify or discontinue features of the Service at any time. We may update these Terms from time to time; if we make material changes, we will notify you in the app or by email before they take effect. Continuing to use laughmi after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Malaysia, without regard to its conflict-of-law principles. Any dispute will be resolved in the courts of Malaysia.
